My advice:
Start writing and see what people say then. Wait until we know a litte more than the first few pages. If the setting seems HP that will be a big factor for people comparing to HP.
But if you have your onw plot and caracters go ahead and write it. Think about what others think when they critizie not before.

If it has magic in, these days, people will think it's Harryish, seriously don't worry about it, also it seems like Charlie Bone, which someone mentioned earlier. Also, you could consider calling them the wizard/witch a mage instead? Sounds good, if you post it/ have posted it, please let me know?
