The universe is a pretty huge place, and pretty old, too, by human standards. millions of suns have been born and have died since its creation, and with them, countless planets. Just because we need oxygen and we need sunlight and we need water and all these things, it doesn't mean that every alien in the universe does. If you take into account the theory of evolution, they would just evolve to fit whatever planet they evolved on. When you consider that, the 'habitable zone' expands to a pretty big range.
With that big range comes a larger chance that life will evolve in such a way that they will become intelligent. That intelligence, howeever, probably differs considerable from our own standards. When you think about it, it'd be pretty astounding if they did.
So yes to life, yes to itelligence, no to it being even remotely the same as what we have on earth.
